Cross-Border Data Governance

Abstract

Data localization (SDIS-03) governs what a single jurisdiction requires; cross-border data governance governs what happens at the seam between two or more jurisdictions with different, sometimes conflicting, requirements. This paper traces the history of cross-border data governance as a legal and technical discipline and surveys the current multilateral and bilateral mechanisms for lawful cross-border data flow — adequacy decisions, standard contractual clauses, and emerging data-space treaties. It specifies the technical enforcement architecture needed to make these legal instruments operate reliably at data-flow speed rather than as manual, case-by-case legal review. It presents seventeen case studies and closes with economic and organizational considerations, a seven-phase implementation roadmap, a glossary, and a self-assessment checklist.
